### sec.59 Chief executive must ensure police officer or registered teacher who is also a public sector employee holds exemption
This section applies if—
the chief executive of a public sector entity engages a person who is a police officer or registered teacher to perform child-related duties on the basis the person made an application mentioned in section 58 (1) (b) ; and
when the chief executive engages the person, the person is also a public sector employee; and
either of the following happens—
the person’s application is withdrawn under the Working with Children Check Act 2000 ;
the person is issued a negative notice.
The chief executive must ensure the person does not continue to perform child-related duties.

(sec.59-ssec.1) This section applies if— the chief executive of a public sector entity engages a person who is a police officer or registered teacher to perform child-related duties on the basis the person made an application mentioned in section 58 (1) (b) ; and when the chief executive engages the person, the person is also a public sector employee; and either of the following happens— the person’s application is withdrawn under the Working with Children Check Act 2000 ; the person is issued a negative notice.
(sec.59-ssec.2) The chief executive must ensure the person does not continue to perform child-related duties.
- (a) the chief executive of a public sector entity engages a person who is a police officer or registered teacher to perform child-related duties on the basis the person made an application mentioned in section 58 (1) (b) ; and
- (b) when the chief executive engages the person, the person is also a public sector employee; and
- (c) either of the following happens— (i) the person’s application is withdrawn under the Working with Children Check Act 2000 ; (ii) the person is issued a negative notice.
- (i) the person’s application is withdrawn under the Working with Children Check Act 2000 ;
- (ii) the person is issued a negative notice.
- (i) the person’s application is withdrawn under the Working with Children Check Act 2000 ;
- (ii) the person is issued a negative notice.
