### sec.58 Chief executive must ensure person holds working with children authority
The chief executive of a public sector entity must ensure a person does not perform a child-related duty in the entity unless—
the person holds a working with children authority; or
if the person is a police officer or registered teacher—the person has made a working with children check (exemption) application under the Working with Children Check Act 2000 .
Subsection (1) applies even if the person is a public sector employee at the time the chief executive proposes to engage the person to perform the child-related duty.

(sec.58-ssec.1) The chief executive of a public sector entity must ensure a person does not perform a child-related duty in the entity unless— the person holds a working with children authority; or if the person is a police officer or registered teacher—the person has made a working with children check (exemption) application under the Working with Children Check Act 2000 .
(sec.58-ssec.2) Subsection (1) applies even if the person is a public sector employee at the time the chief executive proposes to engage the person to perform the child-related duty.
- (a) the person holds a working with children authority; or
- (b) if the person is a police officer or registered teacher—the person has made a working with children check (exemption) application under the Working with Children Check Act 2000 .
