### sec.77 Jury trials
Subsection (2) applies if a proceeding for damages based on a liability for personal injury is before the court and the plaintiff or defendant in the proceeding has elected a trial by jury under the Uniform Civil Procedure Rules 1999 .
Section 58 has effect despite the election unless the trial date has been set before the commencement of this section.
Section 58 does not apply to a proceeding if the proceeding was tried by a jury and, on the hearing of an appeal, the court hearing the appeal set aside the decision and ordered a new trial.
