### sec.78 Temporary and casual employees
The ombudsman may employ the temporary and casual employees whom—
the ombudsman considers are necessary for this Act; and
the ombudsman as the inspector of detention services considers are necessary for the Inspector of Detention Services Act 2022 .
The ombudsman may decide the terms of employment of an employee mentioned in subsection (1) .
However, subsection (2) has effect subject to any relevant industrial instrument within the meaning of the Industrial Relations Act 2016 .
Employees of the ombudsman are employed under this Act and not the Public Sector Act 2022 .

(sec.78-ssec.1) The ombudsman may employ the temporary and casual employees whom— the ombudsman considers are necessary for this Act; and the ombudsman as the inspector of detention services considers are necessary for the Inspector of Detention Services Act 2022 .
(sec.78-ssec.2) The ombudsman may decide the terms of employment of an employee mentioned in subsection (1) .
