### sec.26 Consultation The ombudsman may, during or after an investigation, consult any Minister who is concerned in the action complained of. The ombudsman must consult with a Minister if— either— the Minister asks to consult with the ombudsman about an investigation; or an investigation relates to a recommendation made to the Minister; and the ombudsman is considering making a report under section 50 about the investigation. If, during an investigation, the ombudsman considers there may be grounds for making a report on the investigation that may affect or concern an agency, the ombudsman must, before making the report, give the principal officer of the agency an opportunity to comment on the matter under investigation. In this section— Minister includes a local government’s chairperson, mayor or president. (sec.26-ssec.2) The ombudsman must consult with a Minister if— either— the Minister asks to consult with the ombudsman about an investigation; or an investigation relates to a recommendation made to the Minister; and the ombudsman is considering making a report under section 50 about the investigation.
