What it does
The National Disability Insurance Scheme (Code of Conduct) Rules 2018 are a legislative instrument made under the National Disability Insurance Scheme Act 2013. As stated in the preamble, the NDIS represents a fundamental change to how supports for people with disability are funded and delivered across Australia, with potential to produce major benefits for people with disability, their families and the broader community. The rules establish the NDIS Code of Conduct to support the safety and quality of those supports within the emerging NDIS market.
Part 1 is preliminary. Section 1 names the instrument as the National Disability Insurance Scheme (Code of Conduct) Rules 2018. Section 3 states that it is made under the National Disability Insurance Scheme Act 2013. Section 4 provides definitions, noting that several expressions are already defined in the Act including key personnel, National Disability Insurance Scheme, NDIS Code of Conduct, NDIS provider, and participant. It defines “Act” as the National Disability Insurance Scheme Act 2013 and “Code-covered person” by reference to subsection 5(2) of the Rules themselves.
Part 2 contains the operative provisions. Section 5 is made for the purposes of section 73V of the Act. Subsection 5(2) provides that both NDIS providers and persons employed or otherwise engaged by NDIS providers or members of the key personnel of NDIS providers are Code-covered persons. Subsection 5(3) requires Code-covered persons to comply with the NDIS Code of Conduct set out in section 6. A note to section 5 records that compliance with the NDIS Code of Conduct is a civil penalty provision under section 73V of the Act, enforceable by a court order for a pecuniary penalty.
Section 6 sets out the Code itself. Subsection 6(1) imposes seven positive obligations on a Code-covered person when providing supports or services to people with disability. These are to:
