### sec.13 What is private land
Private land is—
freehold land; or
an interest in land less than fee simple held from the State under another Act.
However, land is not private land to the extent of an interest in any of the following relating to the land—
a mining interest under the Mineral Resources Act ;
a petroleum authority under the P&G Act or 1923 Act petroleum tenure under the 1923 Act ;
a geothermal tenure under the Geothermal Act ;
a GHG authority under the Greenhouse Gas Act ;
an occupation right under a permit under the Land Act 1994 .
Also, land owned by a public land authority is not private land.
(sec.13-ssec.1) Private land is— freehold land; or an interest in land less than fee simple held from the State under another Act.
(sec.13-ssec.2) However, land is not private land to the extent of an interest in any of the following relating to the land— a mining interest under the Mineral Resources Act ; a petroleum authority under the P&G Act or 1923 Act petroleum tenure under the 1923 Act ; a geothermal tenure under the Geothermal Act ; a GHG authority under the Greenhouse Gas Act ; an occupation right under a permit under the Land Act 1994 .
(sec.13-ssec.3) Also, land owned by a public land authority is not private land.
- (a) freehold land; or
- (b) an interest in land less than fee simple held from the State under another Act.
