### sec.100 Deciding compensation by Land Court
Either of the following entities may apply to the Land Court for the Court to decide a resource authority holder’s compensation liability to a public road authority—
the public road authority;
the resource authority holder.
However, the Land Court may decide the compensation liability only to the extent it is not subject to a road compensation agreement.
In making the decision, the Land Court may have regard to—
all prescribed criteria relating to the public road authority, resource authority and notifiable road use; and
whether the applicant has attempted to mediate or negotiate the compensation liability; and
any other matter the Court considers relevant to making the decision.
(sec.100-ssec.1) Either of the following entities may apply to the Land Court for the Court to decide a resource authority holder’s compensation liability to a public road authority— the public road authority; the resource authority holder.
(sec.100-ssec.2) However, the Land Court may decide the compensation liability only to the extent it is not subject to a road compensation agreement.
(sec.100-ssec.3) In making the decision, the Land Court may have regard to— all prescribed criteria relating to the public road authority, resource authority and notifiable road use; and whether the applicant has attempted to mediate or negotiate the compensation liability; and any other matter the Court considers relevant to making the decision.
