### sec.50 Vacation of office by trustee
A trustee of trust land is taken to have vacated office if—
the trustee dies, becomes incapable of acting or can not be located; or
the trustee resigns by signed notice of resignation given to the Minister and the trustee’s resignation takes effect; or
if the trustee is an incorporated body—the incorporated body ceases to exist.
For subsection (1) (b) , a trustee’s resignation takes effect on the earlier of the following days—
the day agreed by the Minister and the trustee;
the day stated by the Minister in a notice given to the trustee;
the day that is 1 year after the day the trustee’s notice of resignation was given to the Minister.
The vacation of office of a trustee must be registered.
The Minister may appoint, under section 44 , a new trustee to fill the vacated office.
