What it does
The Financial Framework (Supplementary Powers) Regulations 1997 (Cth) is a Commonwealth legislative instrument that exercises the authorising function of the Financial Framework (Supplementary Powers) Act 1997 (FFSP Act). The Regulations specify, in detail, every arrangement, grant, and program for which the Commonwealth has supplementary spending and contracting power under s 32B of the FFSP Act.
Under s 32B of the FFSP Act, the Commonwealth has power to make, vary, or administer an arrangement (including a contract, agreement, or deed) if: (a) the Commonwealth would not otherwise have power to make, vary, or administer the arrangement; and (b) the arrangement is for the purposes of a program specified in these Regulations. The FFSP Act also makes clear (s 41) that it does not limit the Commonwealth's executive power under s 61 of the Constitution. The Regulations therefore define the scope of the statutory supplementary power: any expenditure outside the listed programs must find its authority elsewhere, typically in a specific enabling Act or in s 61 of the Constitution.
The Regulations were made in 1997 and have been frequently amended as new programs are added, existing programs are varied, and concluded programs are removed. Their operative provisions are short: regs 16 and 22AB. The substance is in the three Schedules: Schedule 1AA, Schedule 1AB, and Schedule 1B.
