### sec.231 Inspector has powers of authorised person for Electricity Act provisions of continuing application
An inspector has all the functions and powers an authorised person had under the Electricity Act as in force immediately before the commencement—
in relation to an offence under the Electricity Act committed or alleged to have been committed before the commencement; and
in relation to an offence under the Electricity Act committed or alleged to have been committed after the commencement under a repealed offence provision that has continuing application under this part; and
under another provision of the Electricity Act that has continuing application under this part.
If a repealed provision has continuing application under this part and an authorised person under the Electricity Act took action under the provision before the commencement, any inspector may be taken to be the authorised person who took the action.
Subsection (1) does not limit the powers an inspector has under this Act for an investigation.
In this section—
repealed offence provision means a repealed provision that provided for an offence.
repealed provision means a provision of the Electricity Act , as in force immediately before the commencement, that is repealed under this Act.
(sec.231-ssec.1) An inspector has all the functions and powers an authorised person had under the Electricity Act as in force immediately before the commencement— in relation to an offence under the Electricity Act committed or alleged to have been committed before the commencement; and in relation to an offence under the Electricity Act committed or alleged to have been committed after the commencement under a repealed offence provision that has continuing application under this part; and under another provision of the Electricity Act that has continuing application under this part.
(sec.231-ssec.2) If a repealed provision has continuing application under this part and an authorised person under the Electricity Act took action under the provision before the commencement, any inspector may be taken to be the authorised person who took the action.
(sec.231-ssec.3) Subsection (1) does not limit the powers an inspector has under this Act for an investigation.
(sec.231-ssec.4) In this section— repealed offence provision means a repealed provision that provided for an offence. repealed provision means a provision of the Electricity Act , as in force immediately before the commencement, that is repealed under this Act.
- (a) in relation to an offence under the Electricity Act committed or alleged to have been committed before the commencement; and
- (b) in relation to an offence under the Electricity Act committed or alleged to have been committed after the commencement under a repealed offence provision that has continuing application under this part; and
- (c) under another provision of the Electricity Act that has continuing application under this part.
