What it does
The Education and Training Reform Act 2006 (Vic) is Victoria's principal education statute. Its stated purpose under section 1.1.1 is to reform the law relating to education and training in Victoria by providing for a high standard of education and training for all Victorians. The Act consolidates and replaces a suite of predecessor legislation including the Education Act 1958, the TAFE Act 1981, the Vocational Training Act 1994, and the Adult Community and Further Education Act 1991.
The Act's six Chapters regulate every sector of Victorian education: compulsory schooling and government schools (Chapter 2), early childhood education and care (Chapter 2A), post-school VET and TAFE and adult education (Chapter 3), provider registration across all sectors through the Victorian Registration and Qualifications Authority (Chapter 4), and general administration and enforcement (Chapter 5). Chapter 6 contains transitional and savings provisions and Schedule 8 preserves rights and registrations from repealed Acts.
The Act binds the Crown in right of Victoria and, to the extent Parliament has authority, the Commonwealth and other States (s 1.1.4). Certain provisions operate extra-territorially (s 1.1.5).
