### sec.15 Meaning of spousal relationship
A spousal relationship exists between spouses.
A reference to a spouse includes a de facto partner. For definitions of spouse and de facto partner , see the Acts Interpretation Act 1954 , schedule 1 and section 32DA .
A spouse , of a person, includes—
a former spouse of the person; and
a parent, or former parent, of a child of the person.
For subsection (2) (b) , it is irrelevant whether there is or was any relationship between the parents of the child.
In this section—
former parent includes—
a birth parent who stops being a parent of a child under the Surrogacy Act 2010 , section 39 (2) (b) ; and
a birth parent who stops being a parent of a child under a cultural recognition order made under the Meriba Omasker Kaziw Kazipa (Torres Strait Islander Traditional Child Rearing Practice) Act 2020 .
