### sec.55B Matters reference committee must consider
The reference committee may authorise the commission to undertake a specific intelligence operation under section 55A only if it is satisfied—
as required under the section; and
it is in the public interest to authorise the commission to undertake the specific intelligence operation.
In considering the public interest, the reference committee may also have regard to the likely effectiveness of an investigation into criminal activity or corruption without the use of powers available to the commission under this division.
In this section—
criminal activity means any act or omission that involves the commission of an offence.

(sec.55B-ssec.1) The reference committee may authorise the commission to undertake a specific intelligence operation under section 55A only if it is satisfied— as required under the section; and it is in the public interest to authorise the commission to undertake the specific intelligence operation.
(sec.55B-ssec.2) In considering the public interest, the reference committee may also have regard to the likely effectiveness of an investigation into criminal activity or corruption without the use of powers available to the commission under this division.
(sec.55B-ssec.3) In this section— criminal activity means any act or omission that involves the commission of an offence.
- (a) as required under the section; and
- (b) it is in the public interest to authorise the commission to undertake the specific intelligence operation.
