### sec.428 Refusal to comply with notice to produce for fear of reprisal This section applies if— before the commencement, a person was given a notice to produce under section 74; and immediately before the commencement, the person had not complied with the notice to produce and had not been convicted of an offence against section 74(5). Section 74, as amended by the Serious and Organised Crime Legislation Amendment Act 2016 , applies in relation to the notice to produce. s 428 ins 2016 No. 62 s 55 (sec.428-ssec.1) This section applies if— before the commencement, a person was given a notice to produce under section 74; and immediately before the commencement, the person had not complied with the notice to produce and had not been convicted of an offence against section 74(5).
