### sec.246 Special entertainment precincts
This section is about establishing a special entertainment precinct in Brisbane.
A special entertainment precinct is an area in which noise from amplified music that is played at licensed premises in the area is regulated by a local law.
A licensed premises is a licensed premises under the Liquor Act 1992 .
The effect of establishing a special entertainment precinct is that—
noise from amplified music played at licensed premises in the precinct is regulated by a local law instead of the Liquor Act 1992 ; and
requirements imposed under a planning scheme or development approval made or given under the Planning Act about noise abatement apply in relation to particular kinds of development in the precinct.
To establish a special entertainment precinct, the council must—
amend the council’s planning scheme to identify the special entertainment precinct; and
make a local law to regulate noise from amplified music from premises in the special entertainment precinct, in accordance with a permit that is issued for the premises.
However, a local law under this section does not apply to—
a major sports facility under the Major Sports Facilities Act 2001 ; or
an activity that—
is for a major event under the Major Events Act 2014 ; and
is being carried on by, or with the approval of, the major event organiser for the major event.

(sec.246-ssec.1) This section is about establishing a special entertainment precinct in Brisbane.
(sec.246-ssec.2) A special entertainment precinct is an area in which noise from amplified music that is played at licensed premises in the area is regulated by a local law.
(sec.246-ssec.3) A licensed premises is a licensed premises under the Liquor Act 1992 .
(sec.246-ssec.4) The effect of establishing a special entertainment precinct is that— noise from amplified music played at licensed premises in the precinct is regulated by a local law instead of the Liquor Act 1992 ; and requirements imposed under a planning scheme or development approval made or given under the Planning Act about noise abatement apply in relation to particular kinds of development in the precinct.
(sec.246-ssec.5) To establish a special entertainment precinct, the council must— amend the council’s planning scheme to identify the special entertainment precinct; and make a local law to regulate noise from amplified music from premises in the special entertainment precinct, in accordance with a permit that is issued for the premises.
(sec.246-ssec.6) However, a local law under this section does not apply to— a major sports facility under the Major Sports Facilities Act 2001 ; or an activity that— is for a major event under the Major Events Act 2014 ; and is being carried on by, or with the approval of, the major event organiser for the major event.
- (a) noise from amplified music played at licensed premises in the precinct is regulated by a local law instead of the Liquor Act 1992 ; and
- (b) requirements imposed under a planning scheme or development approval made or given under the Planning Act about noise abatement apply in relation to particular kinds of development in the precinct.
- (a) amend the council’s planning scheme to identify the special entertainment precinct; and
- (b) make a local law to regulate noise from amplified music from premises in the special entertainment precinct, in accordance with a permit that is issued for the premises.
- (a) a major sports facility under the Major Sports Facilities Act 2001 ; or
- (b) an activity that— (i) is for a major event under the Major Events Act 2014 ; and (ii) is being carried on by, or with the approval of, the major event organiser for the major event.
- (i) is for a major event under the Major Events Act 2014 ; and
- (ii) is being carried on by, or with the approval of, the major event organiser for the major event.
- (i) is for a major event under the Major Events Act 2014 ; and
- (ii) is being carried on by, or with the approval of, the major event organiser for the major event.
