### sec.99J Proceedings relating to this Act must usually be held in private
A hearing of a proceeding before the tribunal to which this part applies must be held in private.
However, the following are entitled to be present at the proceeding—
each party to the proceeding;
if, under an Act, a party is entitled to be represented by someone else at the proceeding, the party’s representative;
a separate representative representing a child in the proceeding;
the public guardian;
a witness while giving evidence;
a support person for a witness, while the witness is giving evidence;
a person allowed to be present by the tribunal.
This section is subject to the QCAT Act , section 220 .

(sec.99J-ssec.1) A hearing of a proceeding before the tribunal to which this part applies must be held in private.
(sec.99J-ssec.2) However, the following are entitled to be present at the proceeding— each party to the proceeding; if, under an Act, a party is entitled to be represented by someone else at the proceeding, the party’s representative; a separate representative representing a child in the proceeding; the public guardian; a witness while giving evidence; a support person for a witness, while the witness is giving evidence; a person allowed to be present by the tribunal.
(sec.99J-ssec.3) This section is subject to the QCAT Act , section 220 . QCAT Act , section 220 (Tribunal may exclude person)
- (a) each party to the proceeding;
- (b) if, under an Act, a party is entitled to be represented by someone else at the proceeding, the party’s representative;
- (c) a separate representative representing a child in the proceeding;
- (d) the public guardian;
- (e) a witness while giving evidence;
- (f) a support person for a witness, while the witness is giving evidence;
- (g) a person allowed to be present by the tribunal.
