### sec.214K Notice of disqualification
This section applies if—
after considering submissions made by the person, QBCC still considers the person has accumulated 30 demerit points in a period of 3 years; or
the person did not make any submissions.
QBCC must, by notice (a disqualification notice ) given to the person—
inform the person that—
QBCC considers the person has accumulated 30 demerit points in a period of 3 years; and
the person is a disqualified individual for the period applying under section 214L  and stated in the notice; and
if the person holds a building certifier’s licence—cancel the person’s licence.
The disqualification notice must be an information notice.
To remove any doubt, it is declared that part 3 , division 5 does not apply to a cancellation under subsection (2) .

(sec.214K-ssec.1) This section applies if— after considering submissions made by the person, QBCC still considers the person has accumulated 30 demerit points in a period of 3 years; or the person did not make any submissions.
(sec.214K-ssec.2) QBCC must, by notice (a disqualification notice ) given to the person— inform the person that— QBCC considers the person has accumulated 30 demerit points in a period of 3 years; and the person is a disqualified individual for the period applying under section 214L  and stated in the notice; and if the person holds a building certifier’s licence—cancel the person’s licence.
(sec.214K-ssec.3) The disqualification notice must be an information notice.
(sec.214K-ssec.4) To remove any doubt, it is declared that part 3 , division 5 does not apply to a cancellation under subsection (2) .
- (a) after considering submissions made by the person, QBCC still considers the person has accumulated 30 demerit points in a period of 3 years; or
- (b) the person did not make any submissions.
- (a) inform the person that— (i) QBCC considers the person has accumulated 30 demerit points in a period of 3 years; and (ii) the person is a disqualified individual for the period applying under section 214L  and stated in the notice; and
- (i) QBCC considers the person has accumulated 30 demerit points in a period of 3 years; and
- (ii) the person is a disqualified individual for the period applying under section 214L  and stated in the notice; and
- (b) if the person holds a building certifier’s licence—cancel the person’s licence.
- (i) QBCC considers the person has accumulated 30 demerit points in a period of 3 years; and
- (ii) the person is a disqualified individual for the period applying under section 214L  and stated in the notice; and
