engage in conduct has the same meaning as in the Criminal Code.3
entrusted person means any of the following:4
(a) the Director-General;5
(b) an examiner;6
(c) an ACIC staff member;7
(d) a person (other than an ACIC staff member) who has entered8
into a contract, agreement or arrangement with the ACIC that9
provides for conditions relating to the communication or10
recording of ACIC information or the dealing with of ACIC11
records;12
(e) a person who is an employee or agent of a person mentioned13
in paragraph (d).14
examination means an examination under Division 3 of Part 3 of15
this Act, and includes such an examination in which a person16
appears, attends, is before an examiner or is present by way of17
video link, audio link or other means an examiner conducting the18
examination considers appropriate.19
examiner means a person appointed as an examiner under section20
251.21
exempt agency means a body specified, or the person holding an22
office specified, in Part I of Schedule 2 to the Freedom of23
Information Act 1982.24
exempt secrecy provision: see subsection 48(1).25
Federal Court means the Federal Court of Australia.26
federal offence: see subsection 10(2).27
Finance Minister means the Minister administering the Public28
Governance, Performance and Accountability Act 2013.29
firearms background check has the same meaning as in the30
AusCheck Act 2007.31

frisk search means both of the following:1
(a) a search of a person conducted by quickly running the hands2
over the person’s outer garments;3
(b) an examination of anything worn or carried by the person4
that is conveniently and voluntarily removed by the person.5
IGIS official (short for Inspector-General of Intelligence and6
Security official) means:7
(a) the Inspector-General of Intelligence and Security; or8
(b) any other person covered by subsection 32(1) of the9
Inspector-General of Intelligence and Security Act 1986.10
illicit goods means goods the possession of which is a11
contravention of a law of the Commonwealth, a State or a12
Territory.13
imminent: for when a charge for an offence, or a confiscation14
proceeding, is imminent, see subsections 15(1) and (2).15
in contempt of the ACIC: see section 85.16
intelligence or advisory function means any of the functions set17
out in the following:18
(a) paragraph 24(a);19
(b) paragraph 24(b);20
(c) paragraph 24(c);21
(d) paragraph 24(g);22
(e) paragraph 24(i), insofar as the doing of a thing is incidental23
or conducive to the performance of a function mentioned in24
paragraph (a), (b), (c) or (d) of this definition.25
intelligence or security agency means AGO, ASD, ASIO, ASIS,26
DIO or ONI.27
issuing officer means:28
(a) a Judge of the Federal Court; or29
(b) a Judge of the Federal Circuit and Family Court of Australia30
(Division 2); or31
(c) a Judge of a court of a State or Territory; or32
