### sec.166 Authority obtained before commencement
This section applies if—
under an Act other than this Act, an authority is required for an activity; and
the authority was obtained before the commencement of this section.
The holder of the authority may apply to the Minister for the Minister’s approval of measures ( transitional measures ) identifying reasonable and practicable measures for ensuring the activity under the authority avoids or minimises harm to Aboriginal cultural heritage.
The transitional measures have effect, in relation to the carrying out of the activity under the authority, as cultural heritage duty of care guidelines.
In this section—
authority includes a lease, licence, permit or approval.
(sec.166-ssec.1) This section applies if— under an Act other than this Act, an authority is required for an activity; and the authority was obtained before the commencement of this section.
(sec.166-ssec.2) The holder of the authority may apply to the Minister for the Minister’s approval of measures ( transitional measures ) identifying reasonable and practicable measures for ensuring the activity under the authority avoids or minimises harm to Aboriginal cultural heritage.
