- In this case the summary procedure for prosecuting contempt of court has been invoked by originating summons pursuant to Order 75 of the Rules of the Supreme Court. The originating motion alleges that the respondents are guilty on two counts of contempt of court by scandalising the court. The allegations relate to the publication of statements in two books written by the first defendant, Raymond Terrence Hoser (hereafter referred to as "Hoser"), and published by the second defendant, Kotabi Pty Ltd ("Kotabi"). Hoser is the sole director of Kotabi and the sole shareholder. The company was first registered in 1990 and has total paid up shares of $2.
