238 On either account, the discussion between Sue and Christopher, on that occasion, was attended with some strong emotion, at least on behalf of Christopher, which may account for some differences in their recollections of the conversation. However, there are aspects of Sue's evidence, which do not fit the facts, as I have found them. First, she stated that, when she told Christopher that their sisters were contemplating bringing legal action, Christopher responded that it was terrible, because his cousin was also taking him to court. Although, by the time of that conversation, Andrew Harrison had made a demand for payment, he did not issue legal proceedings until April 2007. There is no evidence that, before that date, and in particular at the time of the conversation between Christopher and Sue, Andrew had threatened legal proceedings, or that he was on the verge of instituting proceedings. Secondly, in her version of the conversation with Christopher, Sue stated that Christopher, in substance, confirmed the promises which, she said, he had already given, to make provision for his sisters out of their father's estate. However, as I have already indicated, I am not satisfied, on the balance of probabilities, that Christopher, by that stage, had made any such promise or representation to his sisters. Thirdly, at the stage at which the conversation took place, there was no suggestion then that Christopher was in a financial position to support his sisters or his mother. Fourthly, although, by that time, relationships between Ian and Christopher were becoming strained, it was not until late 2006 that Christopher ceased to work on the farm. There is no evidence that, before that stage, Christopher had given contemplation to selling, or dividing, the farm in such a way that he would be able to make provision, from it, in favour of his mother and sisters. For those reasons, I am not satisfied, on the balance of probabilities, that Christopher made any statement to Sue that he would provide for her sisters and her, or that his father had trusted him to look after his mother and his sisters.
