For the reasons which follow, I am of the opinion that Kameel's submission in this respect is based on a too narrow view of the issues arising with respect to the McDonald's land. In my view, questions of law do arise with respect to the operation of the provisions of the Agreement for Occupation and Lease, the contract and its variants and the effect of the payments which were made by McDonald's. Moreover, the Commissioner's concession with respect to what might have been implicit in the Tribunal's reasoning and findings with respect to the nature of payments is not more than an inference drawn from the Tribunal's reasons. Consequently, the Tribunal's findings of fact in this respect go no further than identifying the timing and quantum of payments. The consequences of those payments in the present context raise a question or questions of law.
