REASONS FOR DECISION
- The Dental Council of New South Wales ('the Council') suspended Dr Hanna's registration as a dental practitioner under s 150 of the Health Practitioner Regulation National Law ('the National Law') on 17 March 2023. The Council provided reasons for its decision on 9 May 2023.
- Dr Hanna appealed to the Tribunal against the decision of the Council under s 159 and s 159B of the National Law. On the External appeal form filed in the Tribunal, Dr Hanna sought an urgent stay of the decision to suspend his registration as a dental practitioner.
- Dr Hanna's application for a stay was heard on 12 May 2023. Subsequent to the hearing, I made the following order: 1. Pursuant to s 165L(2) of the Health Practitioner Regulation National Law (NSW), the decision of the delegates of the Dental Council of New South Wales on 17 March 2023 to suspend Dr Hanna's registration with effect from 18 March 2023, for which reasons were given on 9 May 2023, is stayed until the substantive appeal in this matter has been finally determined. Notes: Dr Hanna's registration as a dental practitioner is subject to the following condition, imposed by the Dental Council of NSW and set out in the Notification of Conditions at p 94 of Exhibit A1: 1.To comply with the Dental Council of NSW's Drug Screening Policy and Participant Procedure - drug screening (as varied from time to time) and: (a) attend for urine drug screening (UDS) on a random basis (b) to authorise the testing facility to forward all results of drug screening to (i) the Council (ii) his treating practitioners (iii) the Council appointed practitioner. He is to bear responsibility for the costs incurred in meeting this condition. The stay granted on 26 May 2023 was granted in reliance upon the undertaking given by Dr Hanna in his statutory declaration made on 25 May 2023. In the event that the undertaking is not honoured, an application may be made to revoke the stay order.
- Mr Hanna's undertaking of 25 May 2023 was in the following terms: Statutory Declaration OATHS ACT 1900, NSW, NINTH SCHEDULE UNDERTAKING I, James Mina Hanna............................, of [address] ................ do hereby solemnly declare and affirm that I willingly provide this undertaking to the NSW Civil and Administrative Tribunal to continue doing the following: 1. To comply with the Dental Council of NSW ("the Council")'s Drug Screening Policy and Participant Procedure - drug screening (as varied from time to time) and: a) attend for Urine drug screening (UDS) on a random basis; b) To authorise the testing facility to forward all results of drug screening to: i. the Council ii. his treating practitioners iii. the Council appointed practitioner. I am to bear responsibility for the costs incurred in meeting this undertaking. 2. To attend for treatment by a psychiatrist specialising in addiction medicine of my choice. The frequency of treatment is to be monthly and: a) I authorise the psychiatrist to inform the Council of any of the following; b) failure to attend for treatment; c) termination of treatment; d) a significant change in health status (including a significant temporary change); e) I will provide the Council with the professional details of the treating practitioner/s; and f) I authorise the treating practitioner to provide the Council with a copy of the treatment reports. I undertake to do the above until my NCAT Appeal under case number 2023/00111811 has been finally determined. And I make this solemn declaration, as to the matter (or matters) aforesaid, according to the law in this behalf made - and subject to the punishment by law provided for any wilfully false statement in any such declaration.
