REASONS FOR DECISION
- Except where otherwise stated all statutory references are references to the Health Practitioner Regulation National Law (NSW) (the National Law).
Introduction
- This is the application of Mr Benjamin Bolton (the applicant) for reinstatement to the Register of Optometrists.
- On 12 October 2021, the Tribunal had cancelled the applicant's registration as an optometrist and ordered that there be a non-review period of 18 months: Health Care Complaints Commission v Bolton [2021] NSWCATOD 160 (the Original Decision).
- In summary, the Tribunal had found that: 1. the applicant had been convicted of criminal offences; 2. the applicant was guilty of unsatisfactory professional conduct (two complaints); 3. the applicant was guilty of professional misconduct; 4. the applicant was impaired;
- The Tribunal did not find that the applicant was not competent to practise optometry.
- The Commission opposes the application for reinstatement.
- For the following reasons, the application for reinstatement is dismissed.
