### sec.738C Individual contracts of employment
This section applies if a transferable employee of a declared channel scheme immediately before the transfer day for the scheme is not employed under a federal enterprise agreement but instead has an individual contract of employment with SunWater.
The transferable employee’s individual contract of employment with SunWater is, on the transfer day, taken to be an individual contract of employment between the employee and the irrigation entity for the declared channel scheme and applies with any necessary changes to give effect to the contract.
In this section—
federal enterprise agreement —
means an agreement, however called, certified under the Fair Work Act 2009 (Cwlth) between SunWater and its employees; and
includes the SunWater Enterprise Agreement 2015–2018.

(sec.738C-ssec.2) The transferable employee’s individual contract of employment with SunWater is, on the transfer day, taken to be an individual contract of employment between the employee and the irrigation entity for the declared channel scheme and applies with any necessary changes to give effect to the contract.
(sec.738C-ssec.3) In this section— federal enterprise agreement — means an agreement, however called, certified under the Fair Work Act 2009 (Cwlth) between SunWater and its employees; and includes the SunWater Enterprise Agreement 2015–2018.
- (a) means an agreement, however called, certified under the Fair Work Act 2009 (Cwlth) between SunWater and its employees; and
- (b) includes the SunWater Enterprise Agreement 2015–2018.
