### sec.733 Permits to occupy under Land Act 1994
Subsections (2) and (3) apply to a permit to occupy unallocated State land, a reserve or a road under the Land Act 1994 , chapter 4 , part 4 (the Land Act provisions ), issued to SunWater and in the area of a declared channel scheme.
On the transfer day for the declared channel scheme, the permit to occupy is taken to be a permit to occupy issued to the irrigation entity for the scheme.
To remove any doubt, it is declared that this section does not limit or otherwise affect the power of the chief executive (land) to deal further with the permit to occupy under the Land Act provisions.
Subsections (5) to (7) apply if SunWater—
has infrastructure for an irrigation service located on a road under the Land Act 1994 in the area of a declared channel scheme; but
has not been issued with a permit to occupy the road under the Land Act provisions.
On the transfer day for the declared channel scheme, the irrigation entity for the scheme is taken to have been issued with a permit to occupy the road.
Subject to the Land Act 1994 , section 180 , the permit to occupy is for a term of 1 year.
Despite the Land Act 1994 , section 177 (8) , the permit to occupy need not be registered.
In this section—
chief executive (land) means the chief executive of the department in which the Land Act 1994 is administered.
