### sec.1065A Transitional provision for dams containing hazardous waste Subsection (3) applies to an application— relating to a dam containing, or a proposed dam that after its construction will contain, hazardous waste; and made under the repealed Act but not decided before the commencement of section 1065. On the commencement of section 1065— any part of the application that is for or about a licence or permit to take or interfere with the flow of water is taken to be an application to which section 1048(2) applied; and the rest of the application is taken to be an application for an appropriate environmental authority under the Environmental Protection Act 1994 to carry out environmentally relevant activities in relation to the dam, or proposed dam. The Environmental Protection Act 1994 applies to the application mentioned in subsection (3)(b)— with necessary changes; and as if the application date for the application is the day section 1065 commences.
