### sec.324 Volumetric survey of resource recovery area to be carried out within stated period
Between 1 June 2019 and the end of August 2019 , the entity having responsibility for the operation of a resource recovery area for a waste disposal site in the waste levy zone must—
ensure that a volumetric survey is carried out for all stockpiled waste at the area; and
give the chief executive a copy of the results of the survey in the approved form.
Maximum penalty—200 penalty units.
The volumetric survey must be carried out in compliance with the requirements prescribed by regulation.
The results of the volumetric survey must—
be in electronic form; and
include a topographical plan complying with specifications advised by the chief executive; and
include details of the following—
the area of the resource recovery area;
the stockpiles of waste at the area; and
be certified as accurate by a surveyor under the Surveyors Act 2003 .
After carrying out the volumetric survey under this section, the entity must ensure that a copy of the results of the survey is kept as a document in hard copy form at the levyable waste disposal site for at least 5 years after the survey is carried out.
Maximum penalty—200 penalty units.
Subsections (6) and (7) apply if an entity having responsibility for the operation of a resource recovery area fails to comply with subsection (1).
The chief executive may arrange for the volumetric survey to be carried out at the resource recovery area and for that purpose may direct an authorised person to enter the area and carry out the survey.
The chief executive may recover the cost of the volumetric survey from the entity as a debt payable by the entity to the State.
