### sec.246 Giving show cause notice
This section applies if the chief executive reasonably believes a person has contravened a prescribed provision.
Before giving a compliance notice about the contravention, the chief executive must give the person a notice (a show cause notice ) inviting the person to show cause why the compliance notice should not be given.
Despite subsection (2) , the chief executive need not give a show cause notice if the chief executive reasonably considers it is not appropriate in the circumstances to give the notice.
The chief executive might not give a show cause notice if the chief executive considers urgent action is necessary to address a danger to public health or safety or giving the notice would be likely to adversely affect the effectiveness of the compliance notice.
