### sec.38 Eligibility to witness the signing of second request
A person is eligible to witness the signing of the second request if the person—
is at least 18 years of age; and
is not an ineligible witness.
A person is ineligible to witness the signing of the second request if the person—
knows or believes that the person—
is a beneficiary under a will of the person making the request; or
may otherwise benefit financially or in any other material way from the death of the person making the request; or
is an owner, or is responsible for the management, of any health facility at which the person making the request is being treated or resides; or
is the coordinating practitioner or consulting practitioner for the person making the request.
(sec.38-ssec.1) A person is eligible to witness the signing of the second request if the person— is at least 18 years of age; and is not an ineligible witness.
(sec.38-ssec.2) A person is ineligible to witness the signing of the second request if the person— knows or believes that the person— is a beneficiary under a will of the person making the request; or may otherwise benefit financially or in any other material way from the death of the person making the request; or is an owner, or is responsible for the management, of any health facility at which the person making the request is being treated or resides; or is the coordinating practitioner or consulting practitioner for the person making the request.
- (a) is at least 18 years of age; and
- (b) is not an ineligible witness.
- (a) knows or believes that the person— (i) is a beneficiary under a will of the person making the request; or (ii) may otherwise benefit financially or in any other material way from the death of the person making the request; or
- (i) is a beneficiary under a will of the person making the request; or
- (ii) may otherwise benefit financially or in any other material way from the death of the person making the request; or
- (b) is an owner, or is responsible for the management, of any health facility at which the person making the request is being treated or resides; or
- (c) is the coordinating practitioner or consulting practitioner for the person making the request.
- (i) is a beneficiary under a will of the person making the request; or
- (ii) may otherwise benefit financially or in any other material way from the death of the person making the request; or
