### sec.146 Personal information not to be recorded or disclosed This section applies to a person who obtains personal information in the course of, or because of, the exercise of a function or power under this Act. The person must not— make a record of the personal information; or disclose the personal information to a person. Maximum penalty—100 penalty units. However, subsection (2) does not apply if the record is made, or the personal information is disclosed— for a purpose under this Act; or with the consent of the person to whom the personal information relates; or in compliance with a lawful process requiring production of documents to, or giving evidence before, a court or tribunal; or as authorised or required by law.
