200Q Requirement to give name and address
(1) A protective services officer on duty who is exercising a function under Division 3 or 4, other than at a designated place, may request a person who is at or in the vicinity of the place the protective services officer is exercising the function to state the person's name and address in the circumstances specified in subsection (2) or (3).
(2) For the purposes of subsection (1), a specified circumstance in the case of a protective services officer exercising a function under Division 3 is that the protective services officer believes on reasonable grounds that the person—
(a) has committed or is about to commit an offence, whether indictable or summary—
(i) against the protective services officer; or
(ii) against, or in connection with, the person being transported, guarded or accompanied by the protective services officer under that Division; or
(iii) against a person who is providing medical assessments, care or treatment to a person referred to in subparagraph (ii); or
(b) may be able to assist in the investigation of an offence referred to in paragraph (a); or
(c) is visiting a person referred to in paragraph (a)(ii); or
(d) is interfering with a person referred to in paragraph (a)(ii) or (iii).
(3) For the purposes of subsection (1), a specified circumstance in the case of a protective services officer exercising a function under Division 4 is that the protective services officer believes on reasonable grounds that the person—
(a) has committed or is about to commit an offence, whether indictable or summary; or
(b) may be able to assist in the investigation of an indictable offence which has been committed or is suspected of having been committed.
(4) A protective services officer who makes a request under subsection (1) must inform the person of the grounds for the protective services officer's belief in sufficient detail to allow the person to understand the nature of the offence or suspected offence.
(5) A person who is requested by a protective services officer on duty to state the person's name and address may request the protective services officer to state, orally or in writing, the protective services officer's name and place of duty.
