### sec.28 When exceptional circumstances exist For this chapter, exceptional circumstances exist for a victim of an act of violence if, because of the victim’s circumstances or the nature of the act, the act has had an unusual, special or out of the ordinary effect on the victim. An elderly person who lives alone suffers injury as a direct result of an act of violence committed against the person in the person’s home. Because of the act, the person becomes seriously concerned about the person’s security. A person who lives in a remote area suffers injury as a direct result of an act of violence committed against the person by a person who lives in the same area. Because of the remoteness of the area, the person becomes seriously concerned about another act of violence being committed against the person by the same person. - 1 An elderly person who lives alone suffers injury as a direct result of an act of violence committed against the person in the person’s home.
