### sec.768 Matter happening in other court
If a question arises as to a matter happening in the court that made the decision, the Court of Appeal may have regard to the material it considers appropriate.
Without limiting subrule (1) , the Court of Appeal may—
call for a report from the court that made the decision; and
if the contents of the report have been made available to the parties to the appeal—act on the report.
(sec.768-ssec.1) If a question arises as to a matter happening in the court that made the decision, the Court of Appeal may have regard to the material it considers appropriate.
(sec.768-ssec.2) Without limiting subrule (1) , the Court of Appeal may— call for a report from the court that made the decision; and if the contents of the report have been made available to the parties to the appeal—act on the report.
