### sec.79C When person is charged for s 79B
This section applies if a proceeding for an offence as mentioned in section 79B (1) is started against a person by notice to appear, arrest or on complaint and summons.
If the proceeding is started by notice to appear, the person is, for section 79B , taken to be charged with the offence when the notice to appear is issued and served on the person.
If the proceeding is started by arrest, the person is, for section 79B , taken to have been charged with the offence when the person is arrested.
If the proceeding is started by complaint and summons, the person is, for section 79B , taken to have been charged with the offence when the complaint and summons is issued and served on the person.
In this section—
notice to appear has the meaning given by the Police Powers and Responsibilities Act 2000 .

(sec.79C-ssec.1) This section applies if a proceeding for an offence as mentioned in section 79B (1) is started against a person by notice to appear, arrest or on complaint and summons.
