### sec.35 Temporary occupation and use of land
To carry out road works, accommodation works or land management activities, the chief executive, or someone authorised in writing by the chief executive, ( temporary occupier ) may temporarily occupy and use land, including roads, and do anything on the land that is necessary or convenient to be done.
However, without limiting subsection (1) , the subsection does authorise the chief executive to extract and use quarry material reserved to the State and administered under the Forestry Act 1959 from land.
In this section—
land management activity means an activity, other than accommodation works or road works, relating to road transport infrastructure or proposed road transport infrastructure.
surveying flora, managing weeds or other pests, clearing vegetation, monitoring air or water quality or noise levels
