### sec.92 Boundary of land subject to reservation of esplanade, before dedication
This section applies if—
the source material that is currently in force for land (the relevant land ) provides for the reservation of land within the relevant land for an esplanade; and
the land proposed as an esplanade has not been dedicated as an esplanade in accordance with the reservation; and
dedication of the esplanade in accordance with the source material would require that the esplanade be bounded on one side by a tidal boundary and on the other by the relevant land.
To remove any doubt, it is declared that, until the esplanade is dedicated in accordance with the reservation—
if the source material came into force before the commencement of this section, subdivisions 2 to 4 apply to the location at law of the tidal boundary of the relevant land unless, under subdivision 1 , the subdivisions do not apply to its location; and
if the source material came into force after the commencement of this section, subdivision 5 applies to the location at law of the tidal boundary of the relevant land.
