What it does
The Supreme Court Rules 1987 (NT) are the primary procedural rules governing litigation in the Supreme Court of the Northern Territory. They govern the full lifecycle of civil proceedings from how a claim is started and the defendant is served, through pleadings, discovery, evidence, trial, and judgment, to enforcement and appeal. Chapter 1A addresses criminal procedure and Chapter 2 addresses appeals.
The Rules were made under the Supreme Court Act 1979 (NT) and apply to all civil proceedings commenced in the Supreme Court on or after the commencement date (rule 1.02). They also apply, with necessary changes, to pending proceedings that were on foot under the former Rules. The current version is as in force at 23 June 2025.
The overarching statement of purpose, in rule 1A.01, frames the entire instrument: "The overarching purpose of this Chapter is to facilitate the resolution of the real issues of substance in dispute in proceedings justly, promptly, economically and in proportion to the nature of the dispute." Rule 1A.02 imposes a duty on both parties and their legal practitioners to assist the Court in achieving this purpose.
