### sec.40 Application of div 6
This division applies to a person who—
before the commencement has started service under articles of clerkship under either of the following rules (a relevant rule ) but not been admitted to the legal profession—
the repealed solicitors rules, rule 17(2)(a)(i) or 17(2)(a)(iii);
the repealed solicitors rules, rule 17(3) to the extent it applies the Solicitors’ Admission Rules 1968 , rule 18(3)(a), (b) or (d); and
has switched to a traineeship.
For subrule (1) a reference to rule 18(3)(a), (b) or (d) is a reference to the Solicitors’ Admission Rules 1968 , rule 18(3)(a), (b) or (d) as in force immediately before 1 July 2004.

(sec.40-ssec.1) This division applies to a person who— before the commencement has started service under articles of clerkship under either of the following rules (a relevant rule ) but not been admitted to the legal profession— the repealed solicitors rules, rule 17(2)(a)(i) or 17(2)(a)(iii); the repealed solicitors rules, rule 17(3) to the extent it applies the Solicitors’ Admission Rules 1968 , rule 18(3)(a), (b) or (d); and has switched to a traineeship.

- (ii) the repealed solicitors rules, rule 17(3) to the extent it applies the Solicitors’ Admission Rules 1968 , rule 18(3)(a), (b) or (d); and
- (b) has switched to a traineeship.
- (i) the repealed solicitors rules, rule 17(2)(a)(i) or 17(2)(a)(iii);
- (ii) the repealed solicitors rules, rule 17(3) to the extent it applies the Solicitors’ Admission Rules 1968 , rule 18(3)(a), (b) or (d); and
