### sec.65 Declaration about continuation of scheme and fund
To remove any doubt, it is declared that the amendment of this Act by the Superannuation (State Public Sector) (Scheme Administration) Amendment Act 2021 (the amendment Act )—
did not establish a new scheme or new fund for the scheme; and
is not intended to—
affect, or purport to affect, the continuation of the scheme or the fund for the scheme; or
otherwise resettle or redeclare the scheme or the fund for the scheme.
Also, to remove any doubt, it is declared that the declaration under subsection (1) applies despite—
the provisions of the 1990 deed being continued as the trust deed for the scheme in the form of the instrument prepared under section 54; and
the Sunsuper transfer within the meaning of section 55, including—
the amendment of the deed under section 56 relating to the Sunsuper transfer; and
any change to the scheme’s name arising from the Sunsuper transfer; and
the appointment of a new trustee of the scheme under an instrument executed by QSuper Board and the new trustee; and
any other changes affecting the operation or management of the scheme or scheme fund arising from the amendment of this Act by the amendment Act.

(sec.65-ssec.1) To remove any doubt, it is declared that the amendment of this Act by the Superannuation (State Public Sector) (Scheme Administration) Amendment Act 2021 (the amendment Act )— did not establish a new scheme or new fund for the scheme; and is not intended to— affect, or purport to affect, the continuation of the scheme or the fund for the scheme; or otherwise resettle or redeclare the scheme or the fund for the scheme.

- (i) the amendment of the deed under section 56 relating to the Sunsuper transfer; and
- (ii) any change to the scheme’s name arising from the Sunsuper transfer; and
- (c) the appointment of a new trustee of the scheme under an instrument executed by QSuper Board and the new trustee; and
- (d) any other changes affecting the operation or management of the scheme or scheme fund arising from the amendment of this Act by the amendment Act.
- (i) the amendment of the deed under section 56 relating to the Sunsuper transfer; and
- (ii) any change to the scheme’s name arising from the Sunsuper transfer; and
