### sec.49 Action by an inspector preserved
A relevant power exercised by an inspector under the repealed Act before the repeal—
if the context permits, continues to have effect for the purposes of this Act; and
if the context permits, is taken to have been exercised under a corresponding provision of this Act.
In this section—
corresponding provision means a provision of this Act, including an applied WHS provision, that corresponds to a provision of the repealed Act under which the power mentioned in subsection (1) was exercised.
relevant power means a power exercised in particular circumstances under the repealed Act that could be exercised under this Act in the same circumstances.
(sec.49-ssec.1) A relevant power exercised by an inspector under the repealed Act before the repeal— if the context permits, continues to have effect for the purposes of this Act; and if the context permits, is taken to have been exercised under a corresponding provision of this Act.
(sec.49-ssec.2) In this section— corresponding provision means a provision of this Act, including an applied WHS provision, that corresponds to a provision of the repealed Act under which the power mentioned in subsection (1) was exercised. relevant power means a power exercised in particular circumstances under the repealed Act that could be exercised under this Act in the same circumstances.
