### sec.45 Regulation-making powers
The Governor in Council may make regulations under this Act.
Without limiting subsection (1) , a regulation may make provision for any matter stated in schedule 1 or otherwise related to safety in recreational water activities.
A regulation may—
prescribe fees for doing any act or providing any service for the purposes of this Act; or
prescribe a penalty for any contravention of the regulations not exceeding 300 penalty units.
Subsection (1) applies as provided under, and subsections (2) and (3) do not limit, the Statutory Instruments Act 1992 .
For the Statutory Instruments Act 1992 , to remove doubt it is declared that —
a reference in sections 24 and 25 of that Act to exceptions includes exemptions, and exceptions or exemptions provided on terms or conditions (if any) prescribed; and
a reference in 30B(1)(b) of that Act to waiving payment of a fee includes reducing or refunding the fee.
