### sch.49-sec.11 Deciding applications for conditional approval
The authority must consider each application for conditional approval and decide to approve, or refuse to approve, the application.
The authority must consider applications for conditional approval in the order they are received by the authority.
If the authority approves an application for conditional approval, the authority must give the applicant written notice of the decision.
The approval is subject to a condition requiring the applicant to engage a stated approved adviser to give the applicant eligible carbon farming advice in accordance with the adviser’s area of specialty as stated on the authority’s website.
The authority must refuse an application for conditional approval if the authority is satisfied the approved adviser to be engaged by the applicant—
is an employee of the applicant; or
has a registered interest in the land the subject of the proposed advice.
If the authority refuses to approve an application, the authority must give the applicant written notice of the decision.
