### sec.40 Disclosure of information
A person must not disclose information obtained in the administration of this Act (or another Act giving functions to the authority) unless the disclosure is made—
with the agreement of the person from whom the information was obtained; or
for the administration of this Act (or another Act giving functions to the authority); or
in legal proceedings; or
under the Crime and Corruption Act 2001 or the Ombudsman Act 2001 ; or
with another lawful excuse.
Maximum penalty—100 penalty units.

- (a) with the agreement of the person from whom the information was obtained; or
- (b) for the administration of this Act (or another Act giving functions to the authority); or
- (c) in legal proceedings; or
- (d) under the Crime and Corruption Act 2001 or the Ombudsman Act 2001 ; or
- (e) with another lawful excuse.
