### sec.371D Notice to leave for change of use
A provider may give a resident a notice requiring the resident to leave the rental premises if—
the provider requires the premises for use as holiday accommodation or other short stay service accommodation; or
the provider requires the premises for a use that is not a residential use; or
the provider proposes to make a change to the premises making it no longer able to be used as a residential dwelling.
The notice must—
be in the approved form; and
state why the resident is being required to leave the rental premises; and
state the day by which the resident is required to leave the rental premises; and
be accompanied by the information required under the approved form for the notice; and
be signed by the provider.
The day by which the resident is required to leave the rental premises must not be earlier than either of the following—
the day that is 1 month after the notice is given to the resident;
if the rooming accommodation agreement is a fixed term agreement—the day the term of the agreement ends.

- (a) the provider requires the premises for use as holiday accommodation or other short stay service accommodation; or

- (c) state the day by which the resident is required to leave the rental premises; and
- (d) be accompanied by the information required under the approved form for the notice; and
- (e) be signed by the provider.
