### sec.312 Application by cotenant for termination for damage or injury
A cotenant may apply to a tribunal for a termination order because the other cotenant, or another cotenant, has intentionally or recklessly caused, or is likely to intentionally or recklessly cause—
serious damage to the premises; or
injury to—
the applicant; or
someone else occupying, or allowed on, the premises.
An application under this section about damage to premises is called an application made because of damage .
An application under this section about injury to a person is called an application made because of injury .
(sec.312-ssec.1) A cotenant may apply to a tribunal for a termination order because the other cotenant, or another cotenant, has intentionally or recklessly caused, or is likely to intentionally or recklessly cause— serious damage to the premises; or injury to— the applicant; or someone else occupying, or allowed on, the premises.
(sec.312-ssec.2) An application under this section about damage to premises is called an application made because of damage .
(sec.312-ssec.3) An application under this section about injury to a person is called an application made because of injury .
- (a) serious damage to the premises; or
- (b) injury to— (i) the applicant; or (ii) someone else occupying, or allowed on, the premises.
