### sec.146 Payments above maximum amount
A person must not require payment of, or accept, a rental bond more than, or amounts as rental bond totalling more than—
for a residential tenancy agreement for which the lessor is the tenant’s employer and gives the tenant a rental subsidy—the amount fixed under subsection (2) ; or
for a rooming accommodation agreement for which the provider is the resident’s employer and gives the resident a rental subsidy—the amount fixed under subsection (2) ; or
otherwise—the maximum rental bond for the residential tenancy agreement or rooming accommodation agreement.
Maximum penalty—20 penalty units.
For subsection (1) (a) and (b) , the amount is the greater of the following amounts—
$400;
the maximum rental bond for the residential tenancy agreement or rooming accommodation agreement.

- (a) for a residential tenancy agreement for which the lessor is the tenant’s employer and gives the tenant a rental subsidy—the amount fixed under subsection (2) ; or
- (b) for a rooming accommodation agreement for which the provider is the resident’s employer and gives the resident a rental subsidy—the amount fixed under subsection (2) ; or
- (c) otherwise—the maximum rental bond for the residential tenancy agreement or rooming accommodation agreement.
