### 26 Risk assessment order
> > (1) The Minister may make orders in relation to the conduct of risk assessments.
>
> > (2) Without limiting the generality of [subsection (1)](#GS26@Gs1@EN) , an order may –
> >
> > > > (a) [*\[Section 26 Subsection (2) amended by No. 46 of 2015, s. 14, Applied:27 Nov 2015\]*](/view/html/inforce/2015-11-27/act-2015-046#GS14@EN) [*\[Section 26 Subsection (2) amended by No. 17 of 2024, s. 32, Applied:01 Nov 2024\]*](/view/html/inforce/2024-11-01/act-2024-017#GS32@EN) provide for the matters, other than matters specified in [section 28](#GS28@EN) , that the Registrar must or may take into account in conducting a risk assessment; and
> > >
> > > > (b) specify how the matters referred to in [paragraph (a)](#GS26@Gs2@Hpa@EN) must or may be taken into account; and
> > >
> > > > (c) specify the matters that the Registrar must not take into account in conducting a risk assessment; and
> > >
> > > > (d) provide for the making of submissions to the Registrar in relation to any matter he or she must take into account in conducting a risk assessment; and
> > >
> > > > (e) provide for what constitutes a change in relevant information about a person for the purposes of making an application for registration under [section 19(3)(b)](#GS19@Gs3@Hpb@EN) ; and
> > >
> > > > (f) provide for matters relating to –
> > > >
> > > > > > (i) the provision of a proposed negative notice; and
> > > > >
> > > > > > (ii) the reconsideration by the Registrar of his or her negative risk assessment that led to the issue of a proposed negative notice; and
> > >
> > > > (g) provide for what constitutes new relevant information about a registered person for the purposes of [section 46](#GS46@EN) .

> > (3) An order may adopt, wholly or in part and with or without modification, and either specifically or by reference, any standards, rules, codes, specifications or other instruments, whether the standards, rules, codes, specifications or other instruments are published or issued before or after the commencement of this section.
>
> > (4) A reference in [subsection (3)](#GS26@Gs3@EN) to standards, rules, codes, specifications or other instruments includes a reference to an amendment of those standards, rules, codes, specifications or other instruments, whether the amendment is published or issued before or after the commencement of this section.
>
> > (5) An order is a statutory rule within the meaning of the [Rules Publication Act 1953](/view/html/inforce/2026-04-12/act-1953-050) .
>
> > (6) [Section 47(3)](/view/html/inforce/2026-04-12/act-1931-059#GS47@Gs3@EN) , [(3A)](/view/html/inforce/2026-04-12/act-1931-059#GS47@Gs3A@EN) , [(4)](/view/html/inforce/2026-04-12/act-1931-059#GS47@Gs4@EN) , [(5)](/view/html/inforce/2026-04-12/act-1931-059#GS47@Gs5@EN) , [(6)](/view/html/inforce/2026-04-12/act-1931-059#GS47@Gs6@EN) and [(7) of the](/view/html/inforce/2026-04-12/act-1931-059#GS47@Gs7@EN) [Acts Interpretation Act 1931](/view/html/inforce/2026-04-12/act-1931-059) apply to an order as if the order were regulations.
