### sec.82 Offences relating to ballot papers
A person must not at a referendum—
wilfully fail to comply with section 22 (10) (c) , 28 (5) (d) , 29 (3) (c) or (d) or 30 (8) (c) or (d) ; or
take a ballot paper out of a polling place otherwise than as authorised under this Act; or
place in a ballot box a ballot paper that has not been—
given to an elector under this Act; or
marked by the elector.
Maximum penalty—20 penalty units or 6 months imprisonment.
A person must not, without lawful excuse, obtain possession of, or have in the person’s possession—
a ballot paper that has been marked by someone else; or
a declaration envelope that has been signed by someone else.

- (c) place in a ballot box a ballot paper that has not been— (i) given to an elector under this Act; or (ii) marked by the elector.
